Terms of Use

These Terms of Use ("Terms") are a legally binding agreement between you ("you," "your," or "User") and ORYN Quest, Inc., a Delaware corporation ("ORYN Quest," "Company," "we," "our," or "us"). These Terms govern your access to and use of the ORYN Quest websites, mobile applications, software, games, media, and related services (collectively, the "Platform"), including every surface you can reach without an account.

By accessing or using any part of the Platform — including simply browsing our marketing pages, watching the ORYN Town cinematic, playing games in the ORYN Play kid zone, viewing a community or shared page, or opening a referral page — you agree to these Terms. If you do not agree to these Terms, do not access or use the Platform.

ARTICLE 1 — SCOPE; WHO THESE TERMS COVER

1.1 Covered Surfaces

These Terms apply to every visitor of the Platform, whether or not you hold an account, including visitors of:

• (a) our marketing, informational, and landing pages at orynquest.com;

• (b) the ORYN Town cinematic and other promotional media presented on the Platform;

• (c) the ORYN Play kid zone (the pages under /play, including its games and the interactive ORYN Town world), subject to the special terms in Article 5;

• (d) publicly accessible community pages and shared content pages (including link-preview and share-card pages for activities, vendors, community groups, and community posts);

• (e) publicly accessible referral pages; and

• (f) any other portion of the Platform that does not require you to sign in.

1.2 Defined Terms

Capitalized terms not defined in these Terms have the meanings given in the ORYN Quest Parent & Guardian Terms and Conditions ("Parent Terms"). "Vendor" means an independent business offering children's activities through the Platform. "Kid Zone" means the ORYN Play area of the Platform described in Article 5.

ARTICLE 2 — RELATIONSHIP TO ROLE AGREEMENTS AND OTHER POLICIES

2.1 Role Agreements Control for Account Holders

If you create or hold an account, additional agreements apply to you and control over these Terms with respect to your use of account features:

• (a) Parents and Guardians are bound by the Parent Terms;

• (b) Vendors are bound by the Vendor Agreement and the Vendor Code of Conduct.

In the event of any conflict between these Terms and an applicable role agreement, the role agreement controls for the account holder's use of account features. These Terms continue to govern surfaces available without signing in.

2.2 Incorporated Policies

The following policies, as published on the Platform's legal pages, are incorporated into these Terms by reference and apply to the extent relevant to your use: the Privacy Policy; the Cookie Policy; the Acceptable Use Policy; the Community Guidelines; the Intellectual Property Policy; the Copyright & DMCA Policy; the AI Features Terms; the Accessibility & Inclusion Policy; and the Child Safety Policy.

2.3 Commerce Terms

Purchases, memberships, credits, bookings, refunds, and cancellations are available only to account holders and are governed by the Parent Terms and the Subscription, Membership, Credits, Refund & Cancellation Policy. Memberships renew automatically each billing period until canceled, as disclosed in those documents; you may cancel at any time in your account settings.

ARTICLE 3 — ABOUT THE PLATFORM; MARKETPLACE ROLE

3.1 What ORYN Quest Is

ORYN Quest operates an online technology marketplace that enables Parents and Guardians to discover, compare, book, and manage children's activities offered by independent Vendors.

3.2 What ORYN Quest Is Not

ORYN Quest is not the organizer, operator, or provider of activities; is not a childcare provider, school, camp, medical provider, or educational institution; does not employ or supervise Vendor staff; and is not responsible for Vendor facilities, equipment, transportation, or supervision of children. Vendors are independent businesses solely responsible for the activities they provide.

3.3 Informational Content

Content on free surfaces of the Platform — including marketing pages, the ORYN Town cinematic, listings previews, share pages, and place or map information — is provided for general information and discovery. It may be incomplete, out of date, or sourced from Vendors or third parties, and it is not advice of any kind.

ARTICLE 4 — ELIGIBILITY AND ACCOUNTS

4.1 Adults Only for Accounts

Accounts may be created and held only by adults aged eighteen (18) or older. Children never have accounts on the Platform. Child profiles are records created and controlled by a Parent or Guardian under the Parent Terms.

4.2 Browsing Without an Account

You may browse the free surfaces of the Platform without registering. Features such as booking, messaging, community posting, reviews, favorites, and the AI assistant require an account and are governed by the applicable role agreement.

4.3 Accurate Information

If you do register, you agree to provide accurate, current information and to keep your credentials secure, as further described in the applicable role agreement.

4.4 Accounts Created in Violation of the Age Rule

Creating an account requires representing that you are at least eighteen (18) years old, and ORYN Quest relies on that representation. If an account is created by or for a person under eighteen in violation of Section 4.1:

• (a) the misrepresentation is a material breach of these Terms, and ORYN Quest may suspend or terminate the account immediately upon discovery, without notice and without liability;

• (b) upon obtaining actual knowledge that an account belongs to a child under thirteen (13), ORYN Quest will terminate the account and delete the personal information collected through it, as described in the ORYN QUEST — CHILDREN'S PRIVACY POLICY;

• (c) to the maximum extent permitted by Applicable Law, ORYN Quest disclaims liability arising from its reasonable reliance on the age representation, and any parent or guardian who knew of and permitted the underage account use is responsible for the account's activity as if it were their own;

• (d) amounts paid through such an account are handled in accordance with Applicable Law, and any Credits or Membership benefits on the account may be suspended pending resolution; and

• (e) anyone may report a suspected underage account to support@orynquest.com, and reports are reviewed promptly.

Nothing in this Section limits any right a person under eighteen may have under Applicable Law, and nothing in it obligates ORYN Quest to monitor for underage use beyond the measures described in our published policies.

ARTICLE 5 — THE KID ZONE (ORYN PLAY AND ORYN TOWN)

5.1 What the Kid Zone Is

The Kid Zone is the free, browser-based play area of the Platform located under /play, including its mini-games, art studio, and the interactive ORYN Town world. It is designed for children to enjoy together with, and under the supervision of, a Parent or Guardian.

5.2 Free; No Accounts; No Tracking

The Kid Zone:

• (a) is free to use and contains no advertising and no in-game purchases;

• (b) requires no account, sign-in, or registration of any kind;

• (c) collects no personal information and uses no tracking technologies: no analytics, no advertising cookies, and no error-monitoring sessions for visits that begin in the Kid Zone; and

• (d) stores game and town progress and creations (such as art studio drawings) only in your own browser's local storage on your own device, under five keys: "oryn-play" (game progress and badges), "oryn-play-art" (art studio creations), "oryn-town-quests" (town quest progress), "oryn-town-spot" (the last place visited in the town), and "oryn-town-sparks" (the day's collected sparks). The only information the Kid Zone sends to our servers is a pair of anonymous town-wide counters for the current calendar day — how many times ORYN Town was opened, and how many sparks all visitors collected together — stored as plain numbers in a single shared daily record with no account, device identifier, session identifier, cookie, or IP address, so nothing in them can be attributed to any person or device; they are never used for advertising, recommendations, or profiling. Clearing your browser data erases progress and creations, and we cannot recover them.

5.3 Vendor Doors on Main Street

Storefronts in the ORYN Town world may display the business names of real Vendors (with a city line) as part of the town scenery. Doors open games and experiences we built — not Vendor content. The only path from the Kid Zone to a Vendor's marketplace page sits behind a deliberate hold-to-confirm "grown-up gate" intended for adults. Vendor appearances in the Kid Zone are never paid placements and are not endorsements.

5.4 Supervision; No Child-Directed Services

The Kid Zone is entertainment only. It is not childcare, education, therapy, or a communication service, and it contains no chat, no messaging, and no AI conversation features. Parents and Guardians are responsible for supervising their children's use of the Kid Zone and of the internet generally.

5.5 Changes to the Kid Zone

We may add, change, or retire Kid Zone games, art tools, and town features at any time without notice. Because Kid Zone progress lives only on your device, retired features may make locally stored progress unusable; we have no obligation to preserve it.

ARTICLE 6 — INTELLECTUAL PROPERTY; LIMITED LICENSE

6.1 Ownership

The Platform and all of its contents — including software, source code, interfaces, graphics, artwork, animations, the ORYN Town three-dimensional world and its scenery, characters, and game assets, the ORYN Town cinematic film and related stills and posters, the ORYN Play games and art studio, databases, compilations, documentation, and the trademarks "ORYN Quest," "ORYN Play," and "ORYN Town" and associated logos — are and remain the exclusive property of ORYN Quest, Inc. and its licensors, protected by United States and international intellectual property laws. Vendor-provided content remains the property of the applicable Vendor. The Intellectual Property Policy describes ownership and licenses in more detail.

6.2 Your Limited License

Subject to your compliance with these Terms, ORYN Quest grants you a limited, personal, non-exclusive, non-transferable, non-sublicensable, revocable license to access and view the Platform's free surfaces and to play the Kid Zone games, in each case for personal, non-commercial purposes only.

6.3 License Restrictions

Except as expressly permitted, you may not:

• (a) copy, reproduce, distribute, publicly display, publicly perform, or create derivative works of Platform content, including the ORYN Town world, cinematic, or game assets;

• (b) scrape, crawl, harvest, or bulk-download Platform content or data, whether manually or by automated means, except by public search engines operating in accordance with our published robots directives;

• (c) use Platform content or data to train, fine-tune, or evaluate any artificial intelligence or machine learning model without our prior written consent;

• (d) reverse engineer, decompile, or disassemble any portion of the Platform except where such restriction is prohibited by law;

• (e) remove or alter any proprietary notices; or

• (f) use ORYN Quest trademarks, or confusingly similar marks or domains, without our prior written consent, except for truthful nominative references.

6.4 Copyright Complaints

We respect the intellectual property of others and respond to copyright notices under the Digital Millennium Copyright Act. To report claimed infringement, or to file a counter-notice, follow the Copyright & DMCA Policy published on our legal pages.

ARTICLE 7 — ACCEPTABLE USE

Your use of every surface of the Platform is subject to the Acceptable Use Policy, which is incorporated into these Terms. In summary, and without limiting that policy, you may not use the Platform to break the law; to harm, endanger, exploit, or attempt to contact children; to harass or defraud anyone; to probe, disrupt, overload, or circumvent Platform security or access controls; to misrepresent your identity or affiliation; or to interfere with any other user's use of the Platform. Conduct rules for community and messaging surfaces appear in the Community Guidelines.

ARTICLE 8 — COMMUNITY AND PUBLIC CONTENT

8.1 Community Surfaces

Community features (groups, posts, comments, reviews) are available to account holders under the Community Guidelines and the applicable role agreement.

8.2 Public Visibility of Shared Content

Certain content is intentionally public so that links can be previewed and shared, including share pages and link-preview cards for activities, Vendors, community groups, community posts, and referral invitations. Do not post anything to a community surface that you are not comfortable being publicly visible, and never include a child's personal information in public content.

8.3 Referral Pages

Referral pages are public landing pages associated with an account holder's referral invitation. Referral rewards, eligibility, and anti-abuse rules are governed by the Parent Terms and any published referral program terms.

ARTICLE 9 — THIRD-PARTY SERVICES AND LINKS

The Platform relies on third-party services (for example, identity, payment, email, mapping, and calendar providers) and may link to external websites, including Vendor websites. Third-party services and external sites are governed by their own terms and privacy policies. ORYN Quest does not control and is not responsible for third-party content, availability, or practices.

ARTICLE 10 — DISCLAIMERS

10.1 As-Is

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, THE PLATFORM AND ALL OF ITS FREE SURFACES — INCLUDING MARKETING PAGES, THE ORYN TOWN CINEMATIC, THE KID ZONE, SHARE PAGES, AND REFERRAL PAGES — ARE PROVIDED "AS IS," "AS AVAILABLE," AND "WITH ALL FAULTS," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, AVAILABILITY, OR UNINTERRUPTED OR ERROR-FREE OPERATION.

10.2 No Guarantee of Listings or Vendor Information

ORYN Quest does not warrant the accuracy, completeness, or currency of listings, Vendor information, place information, or any content displayed on free surfaces, and does not guarantee Vendor performance, availability, or suitability.

10.3 Local Storage

Because Kid Zone progress and creations are stored only on your device, ORYN Quest has no ability to back up, restore, or recover them and disclaims any responsibility for their loss.

ARTICLE 11 — LIMITATION OF LIABILITY

11.1 Exclusion of Certain Damages

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, ORYN QUEST AND ITS OFFICERS, DIRECTORS, EMPLOYEES, CONTRACTORS, LICENSORS, AND SERVICE PROVIDERS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, LOST DATA (INCLUDING LOCALLY STORED KID ZONE PROGRESS), OR LOSS OF GOODWILL, ARISING OUT OF OR RELATING TO THESE TERMS OR THE PLATFORM.

11.2 Cap for Free Surfaces

IF YOU USE ONLY FREE SURFACES OF THE PLATFORM AND HAVE PAID NOTHING TO ORYN QUEST, ORYN QUEST'S TOTAL AGGREGATE LIABILITY ARISING OUT OF OR RELATING TO THESE TERMS OR THE PLATFORM SHALL NOT EXCEED ONE HUNDRED U.S. DOLLARS (USD $100). FOR ACCOUNT HOLDERS, THE LIMITATION-OF-LIABILITY PROVISIONS OF THE APPLICABLE ROLE AGREEMENT GOVERN.

11.3 Consumer Protections Preserved

Some jurisdictions do not allow certain exclusions or limitations. Where prohibited, the exclusions and limitations in this Article apply only to the fullest extent permitted by Applicable Law, and nothing in these Terms waives non-waivable consumer protections or limits liability that cannot lawfully be limited.

ARTICLE 12 — INDEMNIFICATION

To the fullest extent permitted by Applicable Law, you agree to indemnify and hold harmless ORYN Quest, Inc. and its officers, directors, employees, contractors, licensors, and service providers from and against claims, damages, losses, and expenses (including reasonable attorneys' fees) arising out of your violation of these Terms, your violation of Applicable Law, or your infringement of any third party's rights in connection with your use of the Platform.

ARTICLE 13 — SUSPENSION AND TERMINATION OF ACCESS

ORYN Quest may suspend, restrict, or terminate access to the Platform or any portion of it, with or without notice, for any violation of these Terms or an incorporated policy, for conduct that risks harm to children, users, Vendors, or the Platform, to comply with law, or to protect Platform security. Articles 6, 10, 11, 12, 14, and 16, and any provision that by its nature should survive, survive termination. Termination of accounts held under a role agreement is governed by that agreement.

ARTICLE 14 — GOVERNING LAW; DISPUTE RESOLUTION; ARBITRATION

14.1 Governing Law

These Terms and any dispute arising out of or relating to them or the Platform are governed by the laws of the State of Delaware, without regard to conflict-of-laws principles, except to the extent superseded by federal law or otherwise required by Applicable Law. Nothing in these Terms deprives you of non-waivable rights or protections afforded under the laws of your state of residence.

14.2 Informal Resolution First

Before initiating arbitration or litigation, you and ORYN Quest agree to attempt in good faith to resolve any dispute informally. Send a written notice describing the dispute and the relief requested to support@orynquest.com. The parties will engage in good-faith discussions for at least sixty (60) days after receipt of the notice before commencing arbitration or litigation, unless prohibited by Applicable Law.

14.3 Binding Arbitration; Class Waiver

Except where prohibited by Applicable Law, any dispute arising out of or relating to these Terms or the Platform shall be resolved exclusively through final and binding individual arbitration administered by the American Arbitration Association (AAA) under its consumer arbitration rules then in effect, rather than in court. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, CLAIMS MAY BE BROUGHT ONLY IN AN INDIVIDUAL CAPACITY; CLASS ACTIONS, CLASS ARBITRATIONS, CONSOLIDATED ARBITRATIONS, AND REPRESENTATIVE ACTIONS ARE WAIVED; AND BOTH PARTIES WAIVE ANY RIGHT TO A JURY TRIAL. Nothing in this Article waives any right to seek public injunctive relief in a forum where Applicable Law provides that such a right cannot be waived. This Article is intended to be consistent with, and for account holders is superseded by, the dispute-resolution articles of the applicable role agreement.

14.4 Exceptions

Nothing in this Article prevents either party from (a) seeking injunctive or equitable relief to protect intellectual property, confidential information, or Platform security; (b) filing an individual claim in small claims court where jurisdictional requirements are satisfied; or (c) reporting matters to, or cooperating with, governmental agencies.

14.5 Venue; Limitation Period

For any dispute not subject to arbitration, the exclusive venue is the state or federal courts located in the State of Delaware, unless Applicable Law requires otherwise. To the fullest extent permitted by Applicable Law, any claim must be commenced within one (1) year after it arose or reasonably should have been discovered. This limitation does not apply to claims for personal injury or wrongful death, claims belonging to a minor, or claims under a statute whose limitation period cannot lawfully be shortened by agreement.

ARTICLE 15 — CHANGES TO THESE TERMS

ORYN Quest may update these Terms from time to time. When we do, we will post the revised version on the Platform's legal pages, update the version number and effective date above, and, for material changes, provide reasonable advance notice through the Platform or by email. Account holders may be prompted to review and accept updated terms before continuing to use account features. Your continued use of the Platform after changes take effect constitutes acceptance of the updated Terms. If you do not agree, stop using the Platform.

ARTICLE 16 — GENERAL PROVISIONS

16.1 Entire Agreement

These Terms, together with the documents incorporated by reference and, for account holders, the applicable role agreement, constitute the entire agreement between you and ORYN Quest regarding the surfaces they govern.

16.2 Severability; No Waiver

If any provision of these Terms is held invalid or unenforceable, it shall be modified to the minimum extent necessary or severed, and the remaining provisions remain in full force. No failure or delay by ORYN Quest in exercising any right is a waiver of that right.

16.3 Assignment

You may not assign these Terms without ORYN Quest's prior written consent. ORYN Quest may assign these Terms without restriction, including in connection with mergers, acquisitions, reorganizations, financings, or asset sales.

16.4 Headings; Interpretation

Headings are for convenience only. "Including" means "including without limitation."
