Emergency & Medical Disclaimer

This Emergency & Medical Disclaimer ("Disclaimer") explains the limits of the ORYN Quest platform (the "Platform") with respect to emergencies, medical matters, and the health-related information families share through it. It is issued by ORYN Quest, Inc. ("ORYN Quest," "Company," "we," "our," "us") and works together with the Terms of Use, the Parent & Guardian Terms and Conditions, the Parent Waiver, Release of Liability, Assumption of Risk, and Indemnification Agreement, the Child Safety Policy, the AI Features Terms, and the Privacy Policy. If this Disclaimer conflicts with the Terms of Use or the Parent & Guardian Terms and Conditions, those documents control.
IN ANY EMERGENCY, CALL 911 (OR YOUR LOCAL EMERGENCY NUMBER) IMMEDIATELY. DO NOT USE THE PLATFORM — INCLUDING MESSAGING, SUPPORT EMAIL, OR THE AI ASSISTANT — TO REPORT OR RESPOND TO AN EMERGENCY. THE PLATFORM IS NOT MONITORED IN REAL TIME AND IS NOT AN EMERGENCY SERVICE.
ARTICLE 1 — WHAT THE PLATFORM IS — AND IS NOT
1.1 A Technology Marketplace
ORYN Quest operates an online marketplace through which Parents and Guardians discover and book children's Activities offered by independent Vendors.
1.2 Not a Medical or Care Provider
ORYN Quest is NOT:
- (a) a medical, healthcare, therapeutic, or clinical provider;
- (b) an emergency or crisis service;
- (c) a childcare, daycare, babysitting, or supervision service;
- (d) a school or licensed educational institution; or
- (e) an insurer or insurance advisor.
ORYN Quest does not examine, diagnose, treat, monitor, or supervise any child, does not take physical custody of any child, and does not employ medical professionals to deliver care through the Platform.
1.3 No Doctor-Patient Relationship
No use of the Platform — including creating Child profiles, submitting health or accommodation information, using insurance-related features, messaging Vendors, or interacting with AI features — creates a doctor-patient, therapist-client, or any other professional care relationship between you (or your Child) and ORYN Quest. Nothing on the Platform is medical, psychological, developmental, nutritional, or safety advice from ORYN Quest.
ARTICLE 2 — EMERGENCIES
2.1 Call 911 First
If a child or any person is experiencing a medical emergency, is injured, is in danger, or requires urgent assistance, call 911 or your local emergency number immediately. Contact the Vendor and ORYN Quest only after emergency responders have been engaged.
2.2 The Platform Is Not Monitored for Emergencies
Platform channels — in-app messaging, community features, support@orynquest.com, and the AI assistant (text and voice) — are not monitored in real time and must never be used as a substitute for emergency services. A message sent through the Platform may not be seen for hours or longer.
2.3 On-Site Emergencies During Activities
During an Activity, the Vendor is the party present and responsible for emergency response at its premises. Parents should confirm with Vendors, before an Activity, how emergencies are handled, where the Parent must remain reachable, and what pickup procedures apply. The Child Safety Policy requires Vendors to notify Parents promptly of injuries, illnesses, and emergencies.
ARTICLE 3 — VENDORS ARE INDEPENDENT AND RESPONSIBLE FOR ON-SITE SAFETY
3.1 Sole Responsibility of Vendors
Vendors are independent businesses. Vendors — not ORYN Quest — are solely responsible for:
- (a) the safety of their premises, facilities, and equipment;
- (b) supervision of children during their Activities;
- (c) first aid readiness, emergency response protocols, and any medical response during their Activities;
- (d) hiring, training, and qualifying their own staff; and
- (e) compliance with all laws applicable to their Activities, including health, safety, and licensing requirements.
3.2 No Verification by ORYN Quest
ORYN Quest does not independently verify Vendor staff qualifications, first-aid or CPR certifications, medical training, insurance coverage, or accommodation capabilities. Vendor statements on these subjects are self-attestations by the Vendor. Parents should verify directly with the Vendor any qualification or capability that matters to their decision. ARTICLE 4 — PARENT-PROVIDED HEALTH AND ACCOMMODATION INFORMATION
4.1 What Parents May Provide
The Platform allows Parents to record information in Child profiles — such as age, interests, behavioral notes, accessibility and support needs (for example, sensory supports or mobility considerations), and, optionally, insurance details for insurance-eligible Activities — and to submit accommodation requests for Activities.
4.2 Why It Is Collected, and What It Does Not Do
This information is collected for a narrow purpose: to help match families with suitable Activities and to convey to Vendors, in advance, information the Parent wants the Vendor to have. Providing this information:
- (a) does NOT create any medical, monitoring, or care duty on the part of ORYN Quest;
- (b) does NOT mean ORYN Quest has reviewed it for medical accuracy, completeness, or significance;
- (c) does NOT guarantee that a Vendor will read it, act on it, or be able to accommodate it — Vendors decide whether accommodations can reasonably be provided; and
- (d) is NOT a substitute for direct Parent-to-Vendor communication about serious medical conditions, allergies, medications, or emergency instructions, which Parents must communicate directly to the Vendor.
4.3 Parent Responsibility for Accuracy
Parents are responsible for keeping health, behavioral, and emergency information accurate and current, and for deciding what to share. How this information is handled and protected is described in the Privacy Policy.
ARTICLE 5 — INSURANCE-RELATED FEATURES
5.1 An Administrative Workflow Only
For certain insurance-eligible (for example, therapy-type) Activities, the Platform offers an insurance-verification workflow through which a Parent may submit insurance details (such as provider, policy number, and group code) and the Vendor or ORYN Quest records a verification status.
5.2 What It Is Not
The insurance-verification feature is an administrative eligibility workflow only. It is not medical advice, not a coverage determination, not a benefits guarantee, and not a recommendation of any treatment or provider. Coverage, eligibility, and claims decisions are made solely by the insurer and the Vendor, and Parents should confirm coverage directly with their insurance carrier before relying on it.
ARTICLE 6 — AI FEATURES AND HEALTH TOPICS
6.1 No Diagnosis, Ever
The Platform's AI features (chat and voice assistants, recommendations, summaries, and insights) never provide medical, psychological, or developmental diagnosis, treatment advice, or crisis response. AI outputs are informational suggestions about Activities and Platform use, may be inaccurate, and must not be relied on as professional advice of any kind, as stated in the AI Features Terms.
6.2 Developmental Observations Are Not Clinical Findings
Any activity suggestions, interest summaries, or developmental observations surfaced by the Platform are generated from Platform usage and Parent-provided information for discovery purposes. They are not screenings, assessments, or clinical findings. Concerns about a child's health or development should be raised with a qualified professional.
ARTICLE 7 — ASSUMPTION OF RISK
Participation in physical, recreational, and educational activities carries inherent risks, including risk of injury. The allocation of those risks, and the releases Parents give, are set out in the Parent Waiver, Release of Liability, Assumption of Risk, and Indemnification Agreement and any Vendor-required waivers, which govern. Nothing in this Disclaimer expands or limits those documents.
ARTICLE 8 — CHANGES TO THIS DISCLAIMER
We may update this Disclaimer from time to time. When we do, we will revise the "Last Updated" date above. For material changes, we will provide notice through the Platform or by email. Continued use of the Platform after an update takes effect constitutes acceptance of the updated Disclaimer.
