Background Check Policy

ARTICLE 1 — PURPOSE AND PLAIN STATEMENT

1.1 Purpose

This Background Check Policy ("Policy") states clearly what ORYN Quest, Inc. ("ORYN Quest," "we," "our," or "us") does and does not do regarding background screening of the independent Vendors — and the staff of those Vendors — who offer Activities through the ORYN Quest platform (the "Platform").

1.2 Plain Statement

ORYN QUEST DOES NOT CURRENTLY CONDUCT, COMMISSION, OR REQUIRE CRIMINAL BACKGROUND CHECKS ON VENDORS OR THEIR PERSONNEL.

In particular, ORYN Quest does not:

  • fingerprint anyone;
  • run criminal-record searches;
  • run sex-offender-registry searches; or
  • independently verify any background check a Vendor claims to have performed.

A Vendor's presence on the Platform — including approval, ratings, or appearance in the ORYN Town game world — is not a representation that any individual has been screened or vetted by ORYN Quest.

1.3 Who Is Bound

This Policy is part of the Vendor-facing document family (ranking in the order of precedence stated in the Vendor Participation Agreement) and is informational for Parents. Capitalized terms not defined here have the meanings given in the Vendor Participation Agreement, the Vendor Terms & Conditions, and the Parent & Guardian Terms and Conditions.

ARTICLE 2 — VENDOR RESPONSIBILITY FOR STAFF SCREENING

2.1 Independent Businesses

Vendors are independent businesses. Each Vendor is solely responsible for selecting, screening, training, and supervising every individual who works with participating Children on its behalf, including:

  • owners and managers;
  • employees;
  • instructors and coaches;
  • contractors;
  • volunteers; and
  • aides and assistants.

2.2 Screening Decisions

Each Vendor is solely responsible for determining what screening is appropriate and lawful for its operations, and for performing it, including where applicable:

  • criminal background checks;
  • reference checks;
  • registry checks; and
  • verification of staff credentials.

2.3 Contractual Representation

Under the Vendor Participation Agreement, each Vendor represents that all personnel having direct interaction with participating Children have completed any background screening REQUIRED BY LAW for that Vendor's operations, and that the Vendor complies with Applicable Law generally. That representation is the Vendor's own promise. ORYN Quest does not audit, confirm, or certify it.

ARTICLE 3 — LEGAL REQUIREMENTS THAT MAY APPLY TO VENDORS

3.1 Child-Serving Program Laws

Many jurisdictions impose licensing, staffing, and screening requirements on child-serving programs. For example, certain child care and child-serving programs operating in California are subject to state licensing and background-clearance requirements administered by state authorities, where those laws apply to the program in question. Whether any such law applies to a given Vendor depends on that Vendor's activities, structure, and location.

3.2 Vendor Duty

Each Vendor is solely responsible for determining which laws apply to it and for complying with them, including:

  • licensing requirements;
  • background-clearance requirements;
  • mandatory-reporting requirements; and
  • supervision requirements.

ORYN Quest does not provide legal advice and does not determine any Vendor's legal obligations.

3.3 Mandatory Reporting

Nothing in this Policy limits any mandatory child-abuse reporting obligation imposed on Vendors or their personnel by Applicable Law.

ARTICLE 4 — WHAT THE PLATFORM PROVIDES

4.1 Platform Safety Tools

While ORYN Quest does not screen individuals, the Platform does operate the following, described accurately:

  • an application and approval flow — every Vendor's business-facing information is reviewed before listings can be published (see the Vendor Verification Policy);
  • authentic Parent reviews and ratings, with automated quality enforcement that places low-rated Vendors on probation;
  • automated message moderation that blocks abusive content and flags off-platform steering for administrative review;
  • in-Platform reporting to support@orynquest.com, with administrative review;
  • a contractual duty on Vendors to report serious safety incidents to ORYN Quest within twenty-four (24) hours; and
  • suspension and removal powers, including immediate suspension where child safety reasonably requires it.

4.2 Kid-Zone Safety by Design

The Platform's kids' game world (ORYN Play / ORYN Town) is built conservatively:

  • it collects no personal information and shows no advertising;
  • Vendor storefronts show business name, category, and city only; and
  • the only path to a Vendor's marketplace page sits behind a deliberate hold-to-confirm gate designed for adults.

4.3 What These Tools Are Not

These tools support marketplace quality and accountability. They are not background checks, are not supervision of Activities, and are not a guarantee of any person's character or any Activity's safety.

4.4 Parents Attend and Supervise

Parents remain responsible for supervision decisions in accordance with each Vendor's rules and the Parent & Guardian Terms and Conditions. ORYN Quest never takes custody of Children.

ARTICLE 5 — PARENT VERIFICATION CHECKLIST

5.1 Verify Directly

Before booking — especially for drop-off programs, physical or water-based activities, or one-on-one instruction — Parents should ask the Vendor directly:

  • Do you run criminal background checks on staff and volunteers who work with children? Through whom, and how often?
  • Is your program subject to state licensing, and can you share your license or exemption status?
  • What certifications do relevant staff hold (for example CPR/first aid, lifeguard, coaching, teaching credentials)?
  • Do you carry liability insurance covering this activity?
  • Who exactly will be working with my child, and what is their experience?
  • What are your supervision ratios, and what are your check-in and check-out procedures?
  • How do you handle emergencies, injuries, and incident notification to parents?
  • May parents observe or remain present?

5.2 Trust Your Judgment

A reputable provider will answer these questions readily. If a Vendor refuses to answer basic safety questions, consider that in your decision and report concerns to support@orynquest.com.

ARTICLE 6 — NO ENDORSEMENT OR CERTIFICATION

None of the following is an endorsement, certification, or safety representation by ORYN Quest, and none is a statement that any individual has been vetted:

  • approval to list on the Platform;
  • marketplace ranking or featured placement;
  • reviews and ratings;
  • promotional inclusion; or
  • appearance in ORYN Town.

ORYN Quest is a technology marketplace and is not a childcare provider, school, camp operator, or licensing authority.

ARTICLE 7 — RESERVED RIGHT TO INTRODUCE SCREENING REQUIREMENTS

7.1 Reservation

ORYN Quest reserves the right to introduce background-screening requirements in the future — for all Vendors or for specific categories — including screening conducted through third-party screening providers, with any lawfully required consents.

7.2 Notice and Cooperation

Any such requirement will be announced with reasonable notice. Vendors are contractually required to cooperate with screening programs ORYN Quest lawfully implements (Vendor Participation Agreement, Section 2.7).

7.3 Policy Updates

If screening practices change, this Policy will be updated so that it always describes actual practice accurately.

ARTICLE 8 — REPORTING SAFETY CONCERNS

8.1 Emergencies

If a child is in immediate danger, contact 911 (or local emergency services) first. Do not rely on Platform messaging or reporting channels in an emergency. Platform reports are reviewed by people and are not an emergency response system.

8.2 Suspected Abuse or Neglect

Reports of suspected child abuse or neglect should be made to law enforcement or the appropriate child protection authority. ORYN Quest also asks that you notify support@orynquest.com so the Platform can act on the Vendor's account.

8.3 Other Concerns

Safety concerns about any Vendor, listing, or message may be reported at any time to support@orynquest.com.

8.4 What Happens After a Report

Reports are reviewed by ORYN Quest. Depending on findings, ORYN Quest may pause listings or bookings during review, place restrictions, suspend, or permanently remove a Vendor, and may report conduct to law enforcement or child protection authorities where appropriate or required by law. 9.1 Related Documents

This Policy should be read together with:

  • the Vendor Verification Policy;
  • the Child Safety Policy;
  • the Trust & Safety Policy;
  • the Vendor Participation Agreement;
  • the Vendor Terms & Conditions;
  • the Vendor Code of Conduct; and
  • the Terms of Use.

In the event of a conflict among Vendor-facing documents, the order of precedence in the Vendor Participation Agreement governs.
